Terms of service
These terms apply to fctl.sh and app.fctl.sh (the "services"), which hyperstructure ("we", "us") runs. By using the services, you agree to these terms. If you use them on behalf of an organization, you agree to them for that organization and confirm that you may.
The fctl software is open source under the MIT license. The license, not these terms, covers the software itself, including running your own instance. These terms cover the services we run.
The services
app.fctl.sh is a hosted fctl control plane. It signs people in, keeps projects and session transcripts, and coordinates the hosts that run Claude Code agents. The agents do not run on our servers: they run on machines you register, with a Claude account you connect, on repositories you link through our GitHub App.
app.fctl.sh is invitation-only. We may change, add or remove features, and we may suspend or stop the services, with notice when we reasonably can.
Your account
- You must be at least 16 years old.
- Give accurate information, and keep your password, devices and tokens secure. You are responsible for what happens under your account, including through the tokens you create.
- If you think someone else has access to your account, change your password and revoke your devices and tokens in Settings right away.
- Admins manage access: they can invite and remove people, and see the users and the audit log.
Claude and other services
- You connect your own Claude subscription. You are responsible for following Anthropic's terms and usage policies, including any rules about automated use and about sharing accounts, and for the usage your sessions count against your plan.
- fctl is built never to use Anthropic API billing, and to pause a session before it would use paid extra usage. Still, keep an eye on your own usage and charges: we are not responsible for what Anthropic charges you.
- GitHub, Google and Anthropic are governed by their own terms. fctl is not affiliated with or endorsed by Anthropic; Claude and Claude Code are Anthropic's trademarks.
Your machines and repositories
- You are responsible for the machines you register as hosts and for what runs on them. Sandboxes reduce the risks of running agents, but do not remove them.
- Agents act on the repositories you link: they push branches and open pull requests. Review their work before you merge or deploy it. Code written by AI can be wrong or insecure, and it can resemble code that others own.
Your content
Your content is what you and your agents put into the services: prompts, messages, code, files, transcripts and secrets. You keep all rights to it. You allow us to host, store, copy, transmit and display it only as needed to run the services for you and for the people you share it with, which for the screenshots your agents publish means anyone who has their links. We do not use it to train AI models.
You are responsible for your content and for having the right to use it, including the code and data your agents work with. Keep your own copies of what matters: your code lives in your repositories, not with us.
Acceptable use
Don't use the services to:
- break the law or infringe anyone's rights;
- create or spread malware, attack systems, or access accounts, systems or data without permission;
- probe or test the services for vulnerabilities, except as described in reporting a vulnerability;
- get around access controls or rate limits;
- overload or disrupt the services, or anyone else's;
- break the terms of Anthropic, GitHub or Google.
We may remove content, or suspend accounts, that break these rules.
Fees
app.fctl.sh is free for now. If that changes, we will tell you in advance, and we will never charge you without your agreement.
Ending
You can stop using the services at any time, and delete your account yourself in Settings. We may suspend or end your access if you break these terms, if an admin removes you, or if we stop the services. When we can, we will tell you first and give you time to take your data with you. The sections about your content, disclaimers, liability and indemnity still apply after your access ends.
Disclaimers
The services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the services will be uninterrupted, secure or free of errors, that agents' work will be correct, or that data will never be lost.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the services. Our total liability for any claim about the services is limited to the greater of what you paid us for them in the 12 months before the claim and USD 100.
Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud, or for death or personal injury caused by negligence, or takes away your rights as a consumer.
Indemnity
If you use the services for a business, you will defend and indemnify us against claims, damages and costs (including reasonable legal fees) that arise from your content or from your breach of these terms.
Changes to these terms
We may update these terms. We will change the date at the top and, for significant changes, tell people who use app.fctl.sh before the changes take effect. If you keep using the services after that, the new terms apply; if you don't agree with them, stop using the services.
General
- These terms and our privacy policy are the whole agreement between you and us about the services.
- If part of these terms cannot be enforced, the rest still applies. If we don't enforce a part of them, we have not given it up.
- You may not transfer these terms to anyone else without our consent. We may transfer them to whoever takes over the services.
